Acceptance and interpretation

Each Eat Drink Share Ballarat Food Tour (‘the Tour’) is operated by SanGim Pty Ltd (ACN 136 189 510) trading as Eat Drink Share Ballarat ABN 69 606 824 217 (‘we’, ‘us’, ‘our’). Please read these terms carefully, as by purchasing a Tour, you agree to be bound by these Terms as varied from time to time.

A reference to a destination in these terms means any café, retail store, provedore, food van/truck, market, fair, residence or any other location at which we may stop on the Tour (‘Destination’).

Consumption of Food and Drink on Tour

By participating in the Tour, you accept that we are acting solely as a tour guide and are in no way responsible for the food or beverages you consume on the Tour.  We are not involved in any way in the preparation or supply of such food or beverages and you agree that the purchase of such items is a contract between you and the Destination involved.  Payment for all food and beverages must be made direct to the Destination.

You are responsible for considering the food and beverages available at each Destination and making your own choices. Please ensure you check the ingredients of all items as we cannot assume responsibility for your allergies, medical conditions or aversions.  We recommend that you talk to the staff at each Destination before consuming any items.  Whilst we may recommend particular types of food or beverages, it is your responsibility to ensure these are suitable for your own circumstances.

Your Obligations

Whilst on the Tour you agree to comply with all applicable laws and regulations and the reasonable directions and safety instructions of your Tour host and any directions provided by the Destinations or stores visited during the Tour.

Prices

The prices for Tours displayed from time to time on the Website are subject to change at any time. Unless otherwise stated, prices are GST inclusive.

Payment

We require up-front payment in full for each Tour and your booking will be confirmed upon receipt of payment.

Walking Tours

Generally the Tours are walking tours and as such, participants shall be required to walk between destinations.  Unless expressly stated, no other form of transportation shall be provided.  The walk is not strenuous and utilises only public roads/footpaths, however, it is your responsibility to satisfy yourself as to your ability to complete the walking component of any Tour. You are encouraged to wear comfortable shoes, appropriate clothing and ensure you are adequately protected from the sun and any inclement weather.

Cancellation or Variation of Tour

We reserve the right to cancel or vary any Tour due to circumstances outside our reasonable control including (without limitation) if we cannot be accommodated by a particular Destination or store, there are insufficient participants or due to poor weather conditions.  If we are forced to cancel the Tour we will give you as much notice as possible and you may choose to transfer your booking to another date or time or we will provide a full refund within seven (7) days.

We reserve the right to deny your access to the Tour for any reason, including if in our reasonable opinion, you have breached any of these Terms or our Website Terms, your access to the Tour violates any applicable law or regulation or our intellectual property rights.

Cancellation Policy

You may cancel your booking up to 48 hours before commencement of the Tour, but please note that we must charge a cancellation fee.  If you cancel your booking up to 48 hours before the commencement of the Tour, we must charge a cancellation fee of 5% to cover our bank charges.  No refund will be provided for bookings cancelled less than 48 hours from the commencement of the Tour.

Limitation of Liability

Subject to any rights you have under any consumer protection law (such as the Australian Consumer Laws) and to the fullest extent permitted by law, we exclude all implied terms and warranties whether statutory or otherwise, relating to the Tour and we will not be liable to you or any third party, and you indemnify us against any loss, damage, cost, expense or injury in contract, tort, under statute or otherwise, howsoever caused.

Our liability to you for loss or damage of any kind arising out of the Tour will be reduced or limited to the extent (if any) that you cause or contribute to the loss or damage.  Our liability is limited, where permissible at law, to the cost of re-supply of the Tour.  You are entitled to certain rights under consumer protection law that cannot be excluded and this clause in only intended to limit our liability where the law allows.

You are responsible for your personal property whilst on the Tour and we take no responsibility for any personal property.

Release

By participating in the Tour, to the extent permitted by law you release us from all claims, actions, suits, demands, costs, damages and expenses in respect of personal injury, damage to property or any other loss or damage including third party claims howsoever caused including whether caused directly or indirectly from the Tour, our actions, omissions, negligence or otherwise.

Relationship with Destinations

Please note that we are in no way associated with the Destinations we visit on the Tour.  We are an independent entity and do not act as agent, employee, contractor or otherwise as a representative of any of the locations we stop at on the Tour.

Circumstances Outside Our Control

We will not be liable to you for any failure on our part to comply with these Terms due to any cause beyond our reasonable control.

Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Victoria, Australia.

Can I buy a Gift Certificate?

Yes. Please see the website to make your gift voucher purchase. The gift voucher is not a tour ticket. The gift voucher recipient must book into a tour using their individually number gift voucher. How long are Gift Certificates valid?

A walking food tour is a unique and fun way to meet fellow food lovers and those interested in wine, food experiences and supporting local businesses. On our tours you can talk food, wine, travel, cooking, eating out, growing your own food, recipes, and food memories until your heart is content. Groups will often consist of locals and tourists from all over Australia and around the world. Together you will sample some of the most delicious food and drink in the Ballarat CBD. The Walking Food Tour is a great way to see Ballarat and find delicious venues. Our Eat Drink Share Ballarat Walking Food Tour is also an opportunity to be a tourist in your own town for a few delicious, informative hours.

How far will we walk on the walking tours?

Each tour will be approximately 2.5km in distance in the Ballarat CBD with brief stop offs at each destination to sample some delights. There are several toilet stops along the way. The walking is gentle.

What should I bring?

Comfortable walking shoes should be worn. Clothing suitable to the weather conditions including an umbrella, coat, sun hat etc. A bag suitable to carry any food or wine purchases you might make along the way. If you make large purchases of wine etc. we can easily arrangements for you to return to the destination for pick up after the tour. Bring your appetite and some friends.

Is there a meal provided?

Sample tastes will be provided in the ticket cost of the Walking Food Tour. You will have the opportunity to make purchases to take home with you along the way. A meal is not included in the ticket price of the tour however you will be eating along the way.

Are tours cancelled due to weather conditions?

You will be contacted if a tour must be cancelled due to weather conditions. It is important that upon booking you include your mobile phone number for this reason. We do not anticipate this happening. If a tour is cancelled due to weather conditions (strictly by the operator only) you will be provided with a full refund. Refunds will not be supplied if individual ticket holders choose not to participate because of any weather conditions. See our T&C’s.

What should I wear?

Please dress for the weather conditions and wear comfortable walking shoes. We encourage you to bring an umbrella on wet days although the vast majority of the tour is spent indoors or under beautiful Ballarat verandas. Ballarat is known for it’s sometimes chilly weather but we will be embracing the cold, rugging up in our warmest attire and braving the cold in order to sample some of Ballarat’s best comforting Winter food and drink.

Can I bring children on the tour?

The Walking Food Tour cost for children and teenagers is the same as for an adult. The samples provided on the tour are pre set and individual diets; tastes, allergies, intolerances etc. are not specifically catered for. You can bring children on the tour, bookings are essential. Please note that some venues are quite small and may not always be able to accommodate a pram.

Can I book a tour for a group?

Yes you can! We welcome group booking and encourage you to make a booking online or telephone 0422694166 to discuss options and dates. A group tour is a fun social occasion for family and or friends and can also be a great team building experience for corporate, volunteer, special interest and sporting club groups. Our tour guides are very experienced in working with professional and large groups and facilitation of corporate activities. Please see the website for tour dates and availability.

Do tours operate every day of the week?

If you are looking for a group (minimum of 12 or more people) booking and the dates listed are not suitable please enquire online or telephone 0422 694166 and we will do our best to accommodate your needs. To ensure a quality tour we cap our tour group numbers at 18 people.

What if I have allergies and/or food intolerances?

Each individual on the tour is responsible for considering the food and beverages available at each destination/venue and making their own choices. How long do the tours run?

Generally the Walking Food Tours will begin at 10am sharp and conclude around 1.30pm. Conclusion times may vary slightly depending on the size of tour groups, group dynamics, weather conditions etc. Time and duration of the Walking Food Tour will be stated on the website and also in the booking confirmation email that you will receive.

Where should we park our car?

Most of the car parking in the Ballarat CBD is 2 hour meter parking. You will require more than 3 hrs parking. There is parking on Lydiard St, north of the train station and also in the multiple level car parks at Central Square Shopping Centre.  If you are using the public bus service you will easily find our start point and if you arriving in Ballarat by train and get off at the Central Ballarat station you will be an easy walk from our start point. The start point for the walking tours will always be included in your booking confirmation email.

Are there age restrictions for the tours?

There are no age restrictions on the tours. Price point for tickets is the same for all age groups including children and teenagers. Alcoholic beverages are sampled on tours and identification may be sought from the venues license holder. Each ticket holder must be able to walk the distance and assess this for him or herself prior to joining the tour.

Will I be told where we will be stopping before the tour?

We do not disclose where we will be stopping off or the venues we will visit, as this is part of the fun of an Eat Drink Share Ballarat Walking Food Tour. We can tell you that you will be sampling a variety of some of central Ballarat’s best food and wine. It will be fun, delicious and social. Samples provided are both sweet and savory and will vary on each tour.

What if I am running late for the tour?

It is important that the tour begins at 10am sharp, as each destination/venue will be expecting the tour group at a particular time and will have the food and drinks waiting. In the interest of providing you the ticket holder the best possible experience and out of respect for the destination’s/venues mostly being small locally owned businesses (they will have prepared the sample for you to enjoy at a particular time) we must commence the tours on time and as scheduled. Partial or in full refunds will not be provided to ticket holders for reasons relating to being late or not arriving for tours. We recommend arriving at least 5 minutes early and planning parking in advance.

Where is the meeting point?

The meeting point will be stipulated in your confirmation of ticket purchase email. The meeting point is in central Ballarat close to public transport options.

If I am unable to attend the tour on the day I have booked can I give my ticket to someone else to use?
